True.

But the former was a felony…the latter a misdemeanor.

I agree with **Bricker** , not a very good article. OTOH, the bill seems like a steaming pile of shit.

Ohio has more billboards for “gentlemens’ clubs” and adult video/toy stores than any place I have ever been, though. I have no problems with strip clubs and porn, but the huge numbers of billboards advertising them is awfully sleazy.

I’ve seen those. LIVE NUDES! LIVE NUDES! It’s as if they are trying to emphasize that they don’t use dead ones

There’s a great short story, ‘On the Far Side of the Cadillac Desert With Dead Folks’ by Joe R. Lansdale, set in Romero’s zombie “universe”, where that sign would in fact be taken to mean exactly that…

It’s found in [The Book Of The Dead](http://www.amazon.com/exec/obidos/tg/detail/-/055327998X/104-8743068-0071114?v=glance).

I noticed that, too, and was confused by it. What does “with privilege” mean, in this context? The consent of the insertee? I was under the impression that it was already illegal to go around cramming things into other people’s orifices without permission, but what do I know?

Sorry if you felt it was a bad article. Having read it through, more than once, it stuck me as having excessive leeway for use on a subjective basis by any tin-horn public official who wants to go the route of [Senator Smoot](http://www.charleswelty.com/authors/nash.htm), as parodied by Ogden Nash. Rooti-ti-toot, indeed.

Maybe it’s some sort of license? Or maybe it’s a sticker you have to put on your hunting/fishing license? Is there a test you have to take first?

Eh? I took it that tampon use wouldn’t be illegal because the proposed law would criminalize

(bolding mine)

That is, that you can insert anything you like into your own cavities, but anyone else’s cavities are off-limits. Am I misreading?

And I must admit I’m generally a bit more moderate…but it’s times like these that I really want to join ranks with the Libertarians.

After having gone head-to-head with Mister Phil Burress, I can safely say that I use him reliably as a weathervane. I always check which way he’s going on an issue, so I know to go the opposite direction. To provide an excellent example of why I hold this position, though not the issue I fought with him on, this organization spent a couple of years getting _porn channels yanked from local hotels_. CCV is nothing but a bunch of metaphorical old biddies peeking through their blinds at those darn kids listening to their newfangled “rock” and “roll” and then writing long-winded letters to the editor about how they should be horsewhipped for their own good.

Looks like good ole Phil gots himself some friends in the statehouse now, and Kentucky can now look down on Ohio.

While I agree the proposed statutes are crazy, I was brought up short by this portion of the original linked article:

“Ohio doesn’t have a lot of beachfront, but swimmers will want to take note…”

I could’ve sworn Ohio had a whole lot of beachfront on its northern side where Lake Erie sits. Granted, frequently the water’s too dirty and/or cold to swim there . 😃

“Lady Chatterly’s Lover?” Pffffff. That’s kiddie stuff.

If you want the hardcore porn, look for the romances, especially the paranormal ones by Laurell K. Hamilton.

My wife finished her new one (#4, “A Stroke of Midnight”). She liked it, but said it was “too pornographic. Not enough plot.”

If it allows every town to set their own definitions of obscenity (as I read it, it does) and then seize the property, assets etc. It allows them to arbitrarily change their definition at will and any time it suits them. So, they are legally allowed to rob and pillage. Then there is the whole “how do you define obscene” fiasco.
>
> Welcome to the Dark Ages.

Unfortunately, obscenity law in general is stupid like this. It is based on a community definition of obscene, allowing the feds (as they have) to take ther case from jurisdiction to jurisdiction, until they find one jury that finds it obscene. In fact, they don’t even have to do that, as they can bankrupt the producers of the challenged material with multiple defenses.

Privilege includes consent, but it also includes the legal right to perform the action even absent consent. For example, a prison guard peforming a body cavity search may not have the consent of the subject, but does have a legal privilege to perform the actions in question.

It appears to me, that the definitions sections complained about in the original article and cussed and discussed here are current law in the state of Ohio. According to the Bill on the web-page cited above, and after a review of the Revised Code, the definitions of Sexual Contact and Sexual Conduct will remainj unchanged. In other words , these are the same definitions that have been used by Ohio for years. So much for the chicken little panic AVN wants to inspire. The only change is that they want these definitions to apply to the new 2907.38, which would criminilize private viewing booths in adult video stores. That may be a bad idea, but the definitions of sexual contact and conduct will be unchanged.

The major thrust of the bill (he, he) is to allow local control of adult businesses by zoning regs and includes methods of appeal for decisions. IIRC, there are also constitutional prohibitions, referenced in the bill, which would prevent an Ohio community from making adult oriented businesses verboten all together. I’m not surprised, as most adult oriented business in most states (iirc) are regulated by zoning now.

As to this bill itself, I don’t know what my opinion is without further reflection - the appeal process seems long and costly, and I am against, generally, the types of takings to pay state’s attorney fees (and I am a state-employed attorney). But regulating adult businesses through zoning is almost as old as adult businesses in this country.

JMHO, and IAAL (a member of the Ohio Bar, even, though I have been on inactive status for years since I began practicing in another state.)

_A Stroke of Midnight_ is one of the “fey” books.

Yup, they’re fairly graphic.
