my point was that Biden might show some signs of senility, and Kamilla could use Pelosi’s law to oust him, the way Pelosi wants to oust Trump.
Not likely, since the law won’t pass in any case. But the law of unintended consequences can do strange things sometimes.
Are you misspelling her name on purpose?
It is not “Pelosi’s law”- it is a provision that is written into the 25th Amendment, totally legal and proper.
nope—I was misspelling it because I’m stupid. Sorry 'bout that.
And thanks for pointing it out to me.
(Where’s the facepalm smiley we had back on the old site?)
Ideas like this, when you are blinded by hate for the president currently in office, always come back to bite you in the ass when your guy is in office.
To paraphrase the Miranda rights; anything that you say can be used against you. And you can be sure that it will. This could become a new tool for the GOP to attack any Democratic future president.
I don’t see this as a real option, just political posturing for the moment. The 25th amendment does not need any adjustment or amendment. And you can expect that any misstep by future presidents of whatever party, will be questioned. And since these actions will not have any affect upon Trump, I really wonder who thinks this is a good idea.
And once again, what is being proposed is already in the 25th Amendment.
Since, as discussed, it appears that the VP needs to sign off on any action, even a second commission populated solely by rabid partisans of the opposite party can’t actually do anything unless the Veep agrees.
What it does do is let the VP make a move when the Cabinet won’t for whatever reason (corrupt or otherwise).
Exactly.
We’re well past “some signs of senility” with the current guy. I don’t think Biden will have to watch his back.
OK that brings us to a potential pitfall there: the 25A language requires the approval of the majority of “either” the Cabinet or of such a body created by law for this purpose.
Is that an exclusive disjunctive? That is, should this be construed as meaning that the Cabinet has the role until/unless the other body is created?
Or would someone argue that then the VP gets to forum-shop to where to make their case that the Boss is going into rutabaga mode (if s/he is the one taking initiative)?
What this move mostly does is put things like Trump’s deranged interview with the Fox Business Channel into the official record. You can’t let a display of insanity like that get buried overnight; it needs to become part of the official history of the debasing of the American presidency.
That’s my reading of it. If they meant the Cabinet only until such a commission was appointed by Congress, they should have said so more explicitly.
One of my CT acquaintances has assured me that this is just setting the stage to set aside Biden in favor of Harris sooner rather than later. Possibly even with Biden’s cooperation and collusion.
Did somebody really use the c word? What kind of lame-ass coup is it that seeks to install the ousted guy’s second in command?
I agree with this. Pelosi isn’t pushing this bill to target Trump. She’s pushing it to target Biden.
Yes, this. But it’s true that, even if it could pass more than just the House, no way it becomes law --Trump still has a veto. But I would guess it’s more directed at the Republicans who will oppose it in Congess, given present circumstances. I don’t think that amounts to game playing, either. I think it’s pretty vitally important to put lawmakers on record about this right now.
Pelosi knows there’s zero chance this bill will even be voted on in the Senate, much less pass there, be signed by the President or have his veto overridden. Biden is not involved or targetted in any way, shape, or form, even if he wins the election. It’s all Kabuki theater.
This is about more than trolling trump. A lot of vulnerable GOP candidates are tightrope walking between distancing themselves from Trump’s crazier outbursts while not angering his base or being noticed and attacked by the man himself.
Putting the 25th amendment into the national conversation is going to force some of those vulnerable candidates to pick a side about Trump’s stream-of-consciousness lunacy. “He’s kidding” or “he’s being sarcastic” or “he’s trolling the liberals” is getting weaker and weaker as Trump gets more and more desperate. And Pelosi’s trolling is just going to make him even angrier and even louder.
She’s priming the pump on a self-perpetuating system designed to damage vulnerable incumbents.
Wouldn’t it be easier for Biden to just resign, if he is in on the plan? Not that I would expect much rational thought from someone suggesting this.
Yeah, that’s the part I don’t understand.
If it was with Biden’s cooperation and “collusion” then they don’t need to do this whole thing.
All he has to do is say, “I resign”, and sign a few documents, and the White House is now Harris’s.
