In Ohio, this is true unless it was an “Intentional Tort”! Then the worker is not precluded from a private suit, and if I remember correct, can take advantage of both remedies.

That’s the same rule as everywhere else. If it’s an intentional tort the injuries weren’t caused by negligence. :slight_smile:

Employers who comply with section 4123.35 of the Revised Code shall not be liable to respond in damages at common law or by statute for any injury, or occupational disease, or bodily condition, received or contracted by any employee in the course of or arising out of his employment, or for any death resulting from such injury, occupational disease, or bodily condition occurring during the period covered by such premium so paid into the state insurance fund, or during the interval the employer is a self-insuring employer, whether or not such injury, occupational disease, bodily condition, or death is compensable under this chapter.

I can’t verify that this is actually the law. I am only reporting what was said by someone who should know in a meeting I attended several years ago.

During a management meeting in a Las Vegas casino, the subject came up of people taking smoke breaks in an unauthorized area.

Somebody said “How about sticking a phony surveillance camera there?”

The Director of Surveillance replied “It is illegal in Nevada to put up a phony surveillance camera.”

So, it might depend on where you are.

The way it worked out – They put up a real camera, put in a request to have the Maintenance Dept do a cable pull, waited two weeks, the smokers found a new place, and the camera was taken down without spending the money to actually run the cable, but the proper paperwork showing the intent to do so was in place during the time the camera was up.

How about one of those “Do not enter! Severe tire damaging devices installed!” signs at each end of the driveway?
