Huh. If you wanna play hardball, that email probably won’t even be considered an offer to which you can agree, but an invitation to treat. The words “good news”, “can subscribe”, “why not do so now” all point to an invitation to treat, not an offer. There may even be a disclaimer at the bottom saying words to that effect, but I don’t have the email. “Excuse the spam” also implies that it’s an advertisement. This is especially so since you don’t subscribe by replying to that email, but instead go though another agreement process, where you expressly agree to terms and conditions. This thread isn’t the place to get legal advice, though. If you want to, open a GQ. At least more lawyers will see it there, and perhaps respond. ---
