From SS 790.25
*(3) LAWFUL USES.–The provisions of ss. 790.053 (law against open carry of firearm) and 790.06 *(laws on obataining a ccw) do not apply in the following instances, and, despite such sections, it is lawful for the following persons to own, possess, and lawfully use firearms and other weapons, ammunition, and supplies for lawful purposes:
…
(n) A person possessing arms at his or her home or place of business;…"
*Paranthetical decription of mentioned statutes added by me for clarity.
That is true. In Florida, a pistol only needs to be “securlely encased or not readily accessible.” Securely Encased is defined as in a glove box, any container with a closeable lid, or–get this–in a holster with a snap or button. And the state does not differintiate between loaded and unloaded. In other words, you can keep a loaded gun in a holster on your passenger seat in the car. That’s just pistols. There are no requirements for long guns. A rifle or shotgun can be stored, or transported anywhere in the vehicle.
From SS 790.25 (5) POSSESSION IN PRIVATE CONVEYANCE.–Notwithstanding subsection (2), it is lawful and is not a violation of s. 790.01 for a person 18 years of age or older to possess a concealed firearm or other weapon for self-defense or other lawful purpose within the interior of a private conveyance, without a license, if the firearm or other weapon is securely encased or is otherwise not readily accessible for immediate use. Nothing herein contained prohibits the carrying of a legal firearm other than a handgun anywhere in a private conveyance when such firearm is being carried for a lawful use. Nothing herein contained shall be construed to authorize the carrying of a concealed firearm or other weapon on the person. This subsection shall be liberally construed in favor of the lawful use, ownership, and possession of firearms and other weapons, including lawful self-defense…
From SS 790.001 Definitions (17) “Securely encased” means in a glove compartment, whether or not locked; snapped in a holster; in a gun case, whether or not locked; in a zippered gun case; or in a closed box or container which requires a lid or cover to be opened for access.
No, I ain’t. . . I used to live in New Jersey, and can tell you that they do not issue concealed carry licenses to anyone except those that need it in the performance of their duties. I will take your word on things, but yeah, it does deserve some looking into! Although, I will say my favorite reference page “Packing.Org” has been brought down–I think it ran into some traffic/admin issues. That was a great starter site to get references. I gotta say, moving from NJ to AZ (then ND, MT, and now GA)? Policies and laws are like night-and-day.
Of course, I fully support states’ decisions on the matter. I’m not sure I’d want 800,000 untrained, unskilled people in Bergen County, NJ with sidearms on their hips. It’s not that the guns themselves will hurt people, I just don’t trust the people that will hurt people. . .
Oh, and DSYoungEsq, we’re discussing the “law of the land”. What are you talking about?
It was brought down by a huge amount of trolls, asshats, and other scum who need to be beaten until they beg for death. The pages owner/admin (I think his name was Mark) had enough and abandoned it. I believe he’s currently in law school.
Back to the OP: Maryland is known among gun owners as one of the top five worst places to be a gun owner. Please be careful, diggleblop.
Are you telling me you went to this guy’s house to get a statement and that’s it? There was no other commission of a crime, and instead of asking him to please put away his piece while he talked to you, you just arrested him? Especially with open carry laws on one’s own property?
Please tell me that there are more extenuating circumstances to this and redeem my already low opinion of law enforcement and our “justice” system.
Oh, wait you just conveniently dropped the matter so you wouldn’t have to argue your position. You got mad at the guy “for being a cock” **on his own property **so you found any convenient excuse to fuck up his day. Nice. I would imagine that his opinion of you is the same as yours of him.
No wonder 80% of the bullies in school are now cops.
all the above is naturally IMHO. I’m sure there are good cops out there somewhere.
Here recently, a police commissioner as charged with carrying a concealed weapon. His gun was registered, but here one must get a permit to carry a concealed weapon, unless one is among a number of duly authorized law enforcement officers. While he was technically guilty, he was not charged since was actually a law enforcement officer, but not one in the jurisdiction he was guilty in.
