# Real estate lawyers--is this a fee tail or simply a violation of the rule against perpetuities?

Isn’t it necessarily not a fee tail because the conveyance is, initially, just to his six individual children? If, for example, at the time of conveyance the landowner could have fathered a seventh child, then that child would be SOL, right?
