I know it would be completely counter to your political positions to support allowing a president, a democratic one who has track record of appointing justices diametrically opposed to Scalia’s positions, with 1/4 of their term left to serve, to appoint a judge. But i also know you were a stalwart supporter of the law and the constitution. So I was generally curious if you, personally, thought any president, regardless of party or political situation in the country, should be able to nominate and have his choice considered by the senate, when they have 11 months left to serve in their presidency.

This is not a trick, or a gotcha. I am sincerely interested in your opinion on this. Because, I have seen you take positions outside your own personal beliefs because of the law and your adherence to it.

So, may I ask, do you think we should ban all presidents in their last year of the presidential term from making any nominations to the supreme court?

I have to disagree. We would talk tough, but not deny any possibility of a confirmation, let alone a blanket refusal even to hold hearings.

Yes, we might stonewall a nominee we don’t like. We might filibuster him. But we would have waited until a name was dropped rather than publicly denying that any nominee could be acceptable.

The Republicans’ refusal to confirm Federal Judges in the numbers we’re seeing is wholly unprecedented. Yes, Democrats would say, “Waitaminnit, this guy is a pro-life advocate, forget it, he’s DOA.” But we’d wait to see the guy’s creds first!

It seems that each subsequent shifting of power is ratcheting up the obstruction. John Roberts was eminently qualified, but his confirmation was historically low in terms of how many votes he got (Biden and Obama both voted no, as they did for Alito).
