1.) For apparently not shoring up a 16-foot trench with either a retaining wall or shoring, and
2.) for allowing his workers to even think that a backhoe would be something to use.

Please. :rolleyes: You stop using powered equipment when within a few feet of a buried utility line to prevent hitting it. I’m surprised they didn’t have any confined spaces rescue gear either on the guy, or on site.
