Retrieving my last paycheck - Do they have to mail it?

Ok, according to Arizona Statute 23-353, they have to mail the paycheck.

I called and asked them to please mail me the check. He replied, “You don’t want to just let me keep it? Since you cost me about 40-50 hours of overtime when you just walked out?”

I don’t see how this is possible, since I only had maybe 15 hours left of the schedule.

“I’m sorry but that’s really not my concern,” I replied.

“Did you just say that’s not your concern?”

“Yes”

I call back. “Are you going to mail me my paycheck?”

“I would appreciate it if you not call me back here”

“Are you going to mail me my paycheck?”

“I would appreciate it if you not call me back here”

If I were you I would mail them a letter stating that if you don’t recieve the cheque in the next two weeks you will begin legal procedings. I would imagine your former employers will cough up the cheque just to avoid any legal hassles that would damage the company’s reputation.

This is insane. I called back and he said we had nothing to talk about, and as far as he’s concerned I’m the biggest loser he’s ever met in his life (this is coming from a guy who has met me for a total of about 3 minutes, is in his mid-30s and might make 20k a year.)

I got mad and went off: Why the ^&* are you being such a %^& ^&* and not just sending me my %^&*( paycheck?!!

He turned around and said to someone: “He’s calling me a faggot!” Which I did NOT say.

I told him: Listen, I just need you to answer the simple question of whether or not you’re going to send my paycheck, because under Arizona state law you are required to.

He replied, “We don’t have anything else to talk about.”

“It’s a yes or no question.”

“If you call back here I’m calling the cops” He hangs up.

How much does it cost to have a lawyer just send a letter or call somebody without beginning any actual legal proceedings? Anyone know?

So, what are the one-sided phone-call recording laws in Arizona? Can you record your conversation with him on the next call?

Involving a lawyer would probably force the employer to cough up the paycheck, but I’m sure you don’t want to spend the money. So the state labor department should be able to help without costing you anything. Keep us posted.

Him: I just want to verify your address, I am going to send that paycheck.

Me: Ok.

Him: Verifies my address

Me: Yes, that’s it.

Him: Ok, it goes out today, you should have it tomorrow!

Me: Thank you.

See, I’m a pretty reasonable person when people who don’t know me aren’t calling me “the biggest loser they’ve ever met.”

I suspect he checked into the legality of it, because the labor department told me that I could file a claim for 3 times the amount of the paycheck.

I’m glad your former employer came to his senses about giving you your last paycheck, but you might still check with the labor department if there is a penalty for having delayed it so long. I understood that you were supposed to get it your last day.

I got a personal check in the mail today, signed by the owner. This tells me that they either threw my real paycheck away, or never made one in the first place.
