The estate doesn’t become the heirs’ property until after probate. Probate is when the deceased’s legally incurred debts get paid off, as much as possible. At that point, the party who owes the money is of course not the deceased, who can’t owe anything anymore, and not the heirs, but the estate itself. ---

Heh, wait till you find out about the legal personhood of corporations! 😁 Sorry, but AFAICT, there’s really no legally valid way to think about a decedent’s estate as being “owned” by a person until probate is completed. It is not owned by the decedent, who is dead and can’t own anything; it is not owned by the heirs, who have no legal claim on any of it until and unless probate determines that there are leftover assets after payment of just debts. If you like, I guess you can think of the estate as being jointly owned by the creditors and the heirs, who are in the process of figuring out who gets what part(s) of it, if any. But I’m not sure a lawyer would agree with you. ---

Probate is basically legal limbo, or a state of indeterminacy. You have to wait for the waveform to collapse to know who owns what. ---

That’s a great answer. The estate is formally a ward of the court. The court controls everything about who can see it, influence it, and change it. In effect it is also a corporation or more precisely a form of trust. A non-living entity with potentially infinite life span. which entity has some specific named humans empowered to act on its behalf and thereby animate the zombie. As the decedent dies, both their assets and their liabilities instantly transmute into the estate. And eventually, when the human court administrative process takes over, some specific human, the executor or personal representative or whatever they call it in any given jurisdiction, is empowered to grasp the controls of the estate and execute the legally mandated processes of creditor notification, creditor payment, and eventual asset distribution. Oh yeah, and tax-paying. Can’t forget taxes. Which are not only inevitable in life, but also early into death. ---
