Well at least this won’t be confusing!
Wait a sec. Fox reporting IM is a tax and therefore upheld. WTF is the decision?
IM upheld.
God I love live reporting. Mind you I hated it when it was ME doing it…
Yup, mandate is constitutional. Roberts joins the left - at least according to ScotusBlog. CNN looking very silly on their front page.
Maybe they are saying that the fine is, in effect, a tax.
So, I’m guessing it’s at least 6-3.
Yep. Was watching CNN. Now they are saying there is “some confusion”.
That’s what it sounds like to me. It’s allowable as a tax but it’s not interstate commerce. I’m not sure what the upshot of all of the fine points will be.
That seems to be the gist of it, John. Basically you can’t mandate it through the Commerce clause but you can tax not buying it.
Medicare expansion upheld as well, with narrow reading. Entire ACA upheld.
Did not see this coming. Apparently it’s not constitutional as an exercise of Congress’ Commerce Clause powers, but it is as an exercise of Congress’ taxation powers.
I guess Justice Bricker would have concurred in the result.
The document is a long, complicated, and carefully constructed argument … and people are reading it with breathless “breaking news” pressure. It’s like watching an undergrad trying to read a book ten minutes before the exam on it.
Countdown until CNN.com reverses their huge banner headline?
They used Mitt Romney’s Massachusetts health care program as an example for IM.
snicker
Is it typical to decide on a point other than that discussed? I never really covered the court.
So the government can tax you for NOT doing something and it is not a penalty/fine? Am I understanding that correctly?
Way to go CNN. What an embarrassment.
From ScotusBlog:
Now CNN reporting entire law upheld.
Headline: Obama Increases Taxes!!
Listening to radio:
Mandate is constitutional
Expanding Medicaid is not.
