While I’ll perfectly willing to declare the guy who recorded his roommate a USDA Choice asshole who should be dismembered and fed to a quintet of rabid platypuses, I’m not sure the fact that his poor roommate was gay makes this story any more heinous. Honestly, if the guy had been straight and had killed himself it wouldn’t lessen the obscenity of the whole situation at all.

However, I’ll happily admit this is my own (alcohol-impaired) judgement speaking, and I’m sure there’s good reason to give this asshole double secret punishment because his victim was gay. Or at least there’s good reason to hold that opinion.

This seems like overkill. There is no reason for these two to go on the sex offender’s registry, even if he was 17, they are not sexual predators. We have already seen people’s lives ruined because they had sex with a 17 year old while they were 18, and now have to register as a sex offender for the rest of their lives. What these two did was terrible, and completely so because the guy committed suicide a day after. But I think suggesting they go on the sex offender’s list because of something stupid they did which did not constitute a sex offense minimizes the purpose of the list.
I agree what they did was dumb, but would anybody really care that much if the guy hadn’t committed suicide? I doubt it. It’s only a tragedy because Clementi took his own life as a result.

Hypothetical:

Boy and Girl gets secretly recorded having sex by Boy’s roommate. Then roommate texts all his buddies and says, “They’re having sex!! Tune in to my iChat to watch!!!”

When Boy and Girl find out, Girl commits suicide.

And just for funsies… let’s say the girl in this scenario is your sister, your daughter, your niece or some other close female relative. I dunno about the rest of you, but I’d be LIVID if it were my daughter! Hell! Even if she DIDN’T commit suicide I’d STILL be livid!!!

I’m an opponent of “hate crime” legislation because I don’t think that a certain class of citizens should have special treatment (OR punishment) above others. Killing a HUMAN BEING should have enough weight on its own.

That being said, this particular offense was noteworthy because there is still a stigma associated with being gay. The roommate had no idea whether he’d divulged his sexual orientation to anyone, including his family. So while videotaping him having sex with a woman would have been bad enough, videotaping him having sex with another man risked further repercussions. But he didn’t care what the fallout was.

To me, it’d be akin to secretly videotaping a married man (whom you casually know) having sex with another woman and publicizing it without caring that not only did you invade this guy’s privacy, but you also risked ruining his marriage.

Well, Jim did get his comeuppance what with prematurely ejaculatating before an audince of all his classmates.

IANAL, but depending on the jurisdiction the plaintiff has up to 20-25 years to collect a judgement. So Clementi’s family could get a judgement now, and garnish their wages for the next 2 decades. Or wait until they have assets. And it’s not like these students don’t have savings accounts, or possibly even money they inheirted from a dead grandparent.

As for the tuition & housing fees; if they’re expelled they won’t see a dime of whatever they’ve already payed for the fall semester. That’s not how it works.

I’m not saying they should, but it would be a possiblity. Child porn laws are pretty strict, even a 17 taking pictures of himself is technically commiting a crime and DA have actually prosecuted (or used the threat of prosection on) teens for doing this. If the other guy was underage it probally would’ve come out be now.

Reading the updates makes me wonder whether Molly is being charged merely because it was her computer all this was done from, or whether there’s additional information that she further aided and abetted. Perhaps it’s the assumption that because it was her computer, she more likely than not gave permission for the iChat dissemination?

Fair enough. I still do not think that this incident was *hate *driven. Frankly, I think the whole idea of hate crimes is overkill to begin with. It’s a crime or not, regardless of the motivation. But that is a whole other debate.

The cynic in me (which is starting to take over) says that she got charged so they can put pressure on her to testify against the guy.

Not them, no, of course not; but we’re seeing right here in this thread a number of people downplaying the awfulness of it all.

You know, I’m reminded of the thought that the opposite of hate isn’t love, it’s indifference. It wasn’t so much that the perpetrator hated the victim or hated his sexuality. It’s much more about being totally indifferent to him . . . or his feelings . . . or the possible consequences. Possibly we need to define, not just crimes of hatred, but crimes of indifference.

(And yes, I’m now thinking about the last ep of Seinfeld.)

Yes, but it’s worse for us. It’s like they can sense something is off, and they just come after us. Especially for MtF transgendered or really effeminate guys…girls can often get away with it a little better.

So what? Why do so many people here think that your emotions are relevant in these situations? Yeah, we’ll pop into the pit and say things fueled by our anger, but assumedly, we get over it and get on with our lives.

If you are actually ruled by your emotions, that means you are acting in ignorance, as emotions will always make things seem different from what they actually are. Making a (big) decision based on a false reality should be beneath every person here.

To wrap it all up: Suicide is a personal choice. It may be influenced by mental illness, and thus not be a valid choice, but it’s still no one else’s fault. Go ahead and charge the guy for the invasion of privacy. But it’s not his fault that the guy had a mental illness, or otherwise didn’t deal with his problems properly.

Come on–how many homosexuals have been forcibly outed without committing suicide?
