Self defense rights question. Video included.

That’s just about the most ridiculous thing I’ve seen on this board. She wasn’t on the offensive, and wasn’t attacking the driver. Hell, she wasn’t even in a defensive or aggressive posture. The fight was over, and the immediate danger to the driver passed. There’s no justification whatsoever for him to use force at that point. Let alone such a vicious application of it.

You don’t get to punch someone and then immediately declare yourself not a threat.

You don’t get to sucker punch a defenseless person just because they hit you 10 seconds ago. If that guy looked like he had a tiny spec of a shred of fear, I would give him the benefit of the doubt. But he didn’t. He was pissed and wanted to hurt her.

  3. Showing fear is a mistake.
  4. Of course he was pissed.
  5. You always hit to hurt. It’s not very effective if you don’t.

Rewatch the video everyone.

She hits him in the face and without the slightest delay says “i’m gone beat yo (mf’ing) ass nigga, what’s up nigga, let’s go nigga” and has her fists clinched at her sides and is making full eye contact. This is 1 second after she has hit him. He stands up to prevent her from hitting him again and she remains in an aggressive posture, banging her fist into her palm and continues to talk about how she is gonna fight him. He throws the next punch that knocks her down and she gets up to continue fighting. Elapsed time from her attack to his is literally 7 seconds.

7 seconds ago she hit him and spit on him, now she is standing over him saying she is gonna beat his ass and “lets go”. She can move 1 step to her right and be between him and the exit, 1 step to her left and be between him and the rear exit. So he had to fight her.

The police investigated and reviewed everything and asked HIM if he wanted to press charges on HER. And people need to stop acting like she is a helpless young child that a grown man beat up. She’s 25 in the prime of her life and he’ll be 60 next year. She punched a senior citizen in the face while he was sitting down and spit on him.

What, so he should have instead fought back and thrown her off the bus immediately, while the bus was still moving?

And the imminent danger to the driver and other passengers wasn’t over until she was either restrained or calmed (which didn’t happen at any time during the video), or off the bus and with the door closed in her face (which didn’t happen until after the driver punched her, threw her off, she got back on, and he threw her off again).

You’re reaching I think. The bus was not in motion. The girl was not actively attacking anybody. The driver had a free route to the exit.

He does not look afraid to me, when he coldcocks her, just pissed off. Call it what it was. Be honest. He hit her because she pissed him off. It wasn’t self-defense. As a a purely legal matter, I think you;d be hard to make a case for self-defense.

If he was really defending himself and defending passengers, then why did the company suspend him and call his actions undefensible?

If it wasn’t self defense, then why didn’t the police arrest him, and why did they ask him to press charges on the lady for assaulting him? Watch the video. She hits him in the face and ONE second later is saying “i’ll beat you mf’in ass, come on” while clenching her fists and smacking it into her hand. In the heat of the moment, the guy thought she was about to hit him for a SECOND time in less than 10 seconds, and she was standing 1 step away from being between him and the exit.

Why didn’t the cops arrest him or press charges?

They fired him because it’s bad press and he’s a city employee. They threw him under the bus.

You have to remember, he was a 59 year old man who had no benefit of hindsight. She had already attacked him once and was threatening to do it again

The bus wasn’t in motion because, as per his job, he stopped it first.

And I didn’t see him cold-clock anyone. Is that from a different incident?

I would love to know your definition of cold clocking someone.

That would be hitting someone cold. This was definitely hot.

The bus driver was attacked, and provoked. She posed a danger to the driver and other passengers regardless of whether the bus was moving. It was capable of moving and a 40,000 lb bus represents a serious danger to other vehicles and pedestrians. She was clearly out of control and presented a danger to those riding on the bus including the driver.

there are laws regarding reasonable provocation and I think this would qualify. Punching her and throwing her off the bus is about right response I would expect of the driver given the provocation.

And I think this situation deserves the appropriate quote:

"Bitches be crazy"
