This is a good point that has been completely missing from discussions where I live. People in all political groups should be afraid of giving the president king-like powers.
The judge would say, “Tough. Comply with the subpoena.” Some of the evidence might be sealed from public view, if the SO could show its publication would compromise an ongoing investigation; but the judge and defense counsel, at least, would get to see it.
