While we’re at it, how is anyone getting arrested for missing a court date for what I assume is a civil trial? If suing someone is enough to compel them to appear in court, that’s a recipe for abuse. ---

Apparently yes a judge has the discretion to issue a bench warrant for failures to appear upon request of the party bringing the suit. In the case of Marshall’s former patients the judge was repeatedly requested to do so by Marshall’s lawyer. From the NYT article: > Court records show that Mr. Marshall’s lawyers repeatedly requested arrest warrants, including in Mr. Vasquez’s case. They filed dozens of briefs arguing that warrants were needed because of the defendant’s “refusal to obey Court orders.” > > Steven Johnson, a lawyer who often represented Mr. Marshall in debt cases, defended the warrants and ensuing arrests as necessary to ensure that debtors attended court dates.
