The only reason that software piracy gives rise to any legal claim is that it constitutes copyright infringement (and sometimes also breach of contract, if at least one copy was obtained legally).

There might also be a violation of the EULA agreed to on installation. In any case, pirating music is exactly equivalent to pirating software.

As for Sony, their punishment should be the installation of malware on all their PCs.

There is no karma here. Sony was right to go after people who infringed their copyrights. The French software firm is right to go after Sony for what Sony did. Both companies are acting perfectly within their rights.

There is no hypocrisy here, unless you can show that the Sony lawyers and officials who are trying to fight music piracy are the same people authorized the unlawful copying of the software in question here.

No un-registered copies of WinZip, or copies of Office you’re not entitled to? I’ve spent 20 years contracting, and despite the most rigorous inventory management systems out there, I’ve never been at a large company that didn’t have illegal copies of software of some description.

Actually, there is karma here. Sony claimed the “high moral ground” when they started filing the lawsuits, and screaming about how illegal downloading was going to destroy them. If Sony had been reasonable in the filing of their lawsuits (going after people making money off illegally shared files, not asking for unreasonable amounts in damages [not to mention actually paying the artists a portion of any damages awarded]) and realizing early on that the future of music storage lay in formats like MP3s and proactively embracing such changes, then this would not be karma.

Given, however, that Sony aggressively fucked over people, this is as much karma, as was Larry Craig getting caught in an airport bathroom.

Maybe I do, maybe I don’t. Doesn’t matter, I’m not out there suing people who might be stealing my work, and I’m not infecting the PCs of my paying customers with malware because I think it’ll keep them from stealing my stuff! Sony’s been doing all of that, that’s what makes this so sweet.
