I think that case would be very hard to make considering that the federal government has the power to organize arm and discipline the militia. Now, I think a case can be made that the federal government has no authority to restrict guns in a way that states explicitly want to allow guns. ---

Urban gun control goes back to the 1920s and '30s, when “A Uniform Act to Regulate the Sale and Possession of Firearms” was adopted by many states, mandating that carry should only be by permit and rarely granted. A host of gun control acts were inspired by late 1960s crime and political violence. But gun violence by people already forbidden by law to possess firearms continues unabated, and gun control has not increased the security of the law-abiding. If we were going to eventually remove guns from American society, the gun control trend would have expanded past the 1980s instead of the reaction we see. The national push to carry and self-defense laws is comparable to America’s eventual disenchantment with Prohibition. ---
