A bad guy is someone who accidentally shoots his toddler in the face. A good guy is that same person 10 seconds before he accidentally shoots his toddler in the face.

Here in my home state of Minnesota, Governor Dayton announced today that he would sign state Senate bill SF878, an omnibus bill that includes several provisions for relaxing current firearms restrictions:
[ul]
[li]Suppressors are now legal (though still Federally regulated NFA items)[/li][li]Firearms now cannot be summarily confiscated in a state of emergency[/li][li]The requirement that permit holders send in a special notification form before carrying on state capitol grounds is rescinded (was redundant given the permit holders’ registry)[/li][li]Reworded state law to eliminate possible interpretation that buying long guns from non-contiguous states was illegal[/li][li]Reworded law regarding carry reciprocity with other states to open more states to honor MN permits.[/li][/ul]
This will of course open a tide of bloodshed and death 😛 **NOT!**

I clicked to FoxNews on another matter and saw another story especially featured:

>
> Federal authorities are seeking to keep a third of the nearly 300 assault rifle parts they seized from a Connecticut gun-maker that prosecutors allege broke federal firearm regulations.
>
> Prosecutors asked a federal judge in Bridgeport earlier this month to allow the U.S. government to retain the AR-15 parts confiscated in September from Stag Arms in New Britain.
>
> Federal agents say they found about 3,000 AR-15 parts without required serial numbers and seized some of them.
>

My question is: What??!? Is this what we’ve come to? Cliven Bundy shoots at cops doing their jobs and is a hero. U.S. seizes illegal gun parts and it’s another anti-gummint headline.

I’ll bet fellow libtards will agree with me. I want to hear from the gun nuts.

I can’t help you with Cliven Bundy. I might be able to help you with the Stag Arms issue. Briefly, Stag Arms was cited for having ~3,000 AR-15 lower receivers within their factory that had not been affixed with a serial number within seven days after their manufacture. The seven days marking requirement is not in the relevant statute, 18 U.S.C. § 923(i), but is [BATFE’s stated interpretation of the statute](https://www.atf.gov/file/55516/download).

> [@](#):
>
> Reading the marking requirement for complete weapons in section 478.92(a) together with the seven day recordkeeping requirement for complete firearms in section 478.123(a), ATF concludes that it is reasonable for a manufacturer to have seven (7) days following the date of completion (to include a firearm in knockdown condition, i.e., complete as to all component parts, or a frame or receiver to be sold, shipped, or disposed of separately) in which to mark the firearm and record its identifying information in the manufacturer’s permanent records.

The lower [receiver](http://en.wikipedia.org/wiki/Receiver_%28firearms%29) on an AR-15 is the part that, when completed, is the “firearm” as far as the BATFE is concerned. As a firearm, it needs a serial number. [26 U.S. Code § 5842](https://www.law.cornell.edu/uscode/text/26/5842). Stag Arms makes roughly 15,000 AR-15s a month. 3,000 lower receivers is therefore about one week’s production for them. One of their excuses for not ‘serializing’ the receivers is that [the guy responsible for doing it was on vacation.](http://news.yahoo.com/feds-seek-keep-assault-rifle-parts-seized-gun-143309740.html)

> [@](#):
>
> At the time, the father of Stag Arms owner Mark Malkowski told authorities that the employee who places serial numbers on parts was on vacation.

BATFE does not claim that any of the receivers entered the stream of commerce, or indeed even left Stag Arms’s factory. For one, the lower receivers were not anodized yet, something AIUI Stag Arms does to all of its lowers before sale, but has nothing to do with whether a lower receiver is sufficiently complete to be considered a firearm.

A BATFE special agent noted a stack of lower receivers on one day, and noticed that the same stack on a visit a week later didn’t have serial numbers yet. That’s basically the controversy, though no doubt BATFE will find other paperwork screwups if Stag’s manufacturing process allowed for this kind of easily foreseeable fault to occur.

Interesting. From your link:

> [@](#):
>
> Besides Malkowski’s father saying the serial number worker was on vacation, another employee told authorities that some parts didn’t have serial numbers because they were going to be used to duplicate parts of guns with serial numbers that were damaged, a practice that also violates regulations, prosecutors said.

I’m assuming that’s why BATFE’s “7-day” interpretation exists. The longer unstamped receivers sit around the factory, the higher the likelihood that they’ll walk off, get stamped with a duplicate number, or accidentally get shipped out without one. Too much room for shenanigans.

I also note that there were 3,000 unstamped receivers, of which only 10% were seized. Of that, 2/3rds were apparently returned (or intend to be), so we’re talking about a whopping 100 receivers. On the one hand, seems like the BATFE should slap their wrist or whatever they intend to do and let them stamp and then sell those receivers. On the other hand, I can’t get my panties in a bunch over 100 receivers for a company that makes 15,000 of them a month.

Is this just news because ZOMG FEDS CONFISCATE GUNS JUST LIKE WE SAID THEY WOULD!!! alarmism?

I think you are more excited about this fox news bullshit than most gun enthusiasts.

Cracking down on manufacturers for regulatory violations is not news any more than the government cracking down on a gun store that is sloppy with how it secures its inventory at night.

First of all, I’m a Democrat. I think being a Democrat is about as relevant to the gun debate as it is to the abortion debate. There are plenty of pro-life Democrats just like there are pro-gun Democrats.

The opportunity to pass those sort of laws are few and far in between. And when those opportunities arise, the hoplophobes screw it up. In fact (as I posted above) LBJ tried to pass laws like that after RFK was assassinated but it got held up in committee by some hoplophobe from Connecticut and the legislation died in committee. What we ended up with was the Gun Control Act of 1968 which created an imperfect scheme of background checks and licensed firearm dealers. There is no guarantee that LBJ could have passed licensing and registration but LBJ was a peculiarly adept legislator and no one could count votes better than him. He thought the legislation could pass if acted upon quickly and with the support of his own party but unfortunately, the hoplophobes of his party stonewalled him long enough to eliminate any chance of the legislation passing.

> Johnson’s bill would ban all mail-order and out-of-state sales of handguns, shotguns and rifles; prohibit the sale of guns to minors; and require national registration of all guns and licensing of all gun owners. There had been little hope of enactment. But the day after Kennedy died from gunshot wounds, LBJ renewed his pressure on the Senate Judiciary Committee to report his bill out and send it to the Senate floor for a vote.
>
> Maryland Sen. Joseph Tydings, a close friend of Kennedy, and a couple of Democratic colleagues wanted the committee to consider a bill they believed was stronger. LBJ thought the Tydings proposal had no chance of passage and feared that any delay to consider it would give the gun lobby time to kill his legislation.
>
> That’s exactly what happened. The Tydings proposal never got beyond the discussion phase, and LBJ’s comprehensive bill failed by a tie vote in the committee. With relentless pressure, he was able to get a bill by October with a prohibition against mail-order sales (LBJ called it “murder by mail order”), sale of guns to minors and importation of “$10 specials,” or cheap guns that were pouring into the country. But Johnson’s pet proposals to license all gun owners and register all guns were defeated.

While it was of course the ‘evil gun lobby’ that defeated universal registration, it was delays from his own side that created the opportunity for them to do so.

The senator from Connecticut that derailed LBJ’s legislation was not imaginary. There was a real opportunity to get universal gun registration and licensing but the gun control side of the debate is mostly run by hoplophobes who are ignorant about guns and gun issues, they just know that guns scare them and they want to get rid of them.
