I doubt he’s actually “embattled.” Talk radio fans love that shit. ---

By his rationale, Scalia et al should have all recused themselves too - after all, they never officiated gay marriages, which perforce makes them biased the other way around (also, in the case of Scalia at least, a conservative Catholic which surely is as horrible and unAmerican as a lib’rul Jew). ---
