Supreme Court Overturns Ban on Virtual Child Porn

I think this is a win for free speech.

There are several types of virtual kiddie porn.

One is a person is ‘calander age’ and adult but looks younger. This is legal.

Also of course a written account of a minor having sex is virtual child porn. vcp Still legal

Computer generated images, like those in the film Final Fantasy, will be legal.

However I thought that a ‘photo manipulation’ of a real child into a lewd image would not be legal. For instance if you take a photo of a young girl in a bathing suit and then use a program like photoshop to ‘erase’ her clothes making her appear nude and then perhaps placing it in lewd setting would be illegal if you could identify the child, as this still harms a real child.
I think this law will go to protect childern. Lets suppose that you make pron for a living. Of course you pron empire has several divisions like bondage porn, clothing fetish porn, etc. Now if vcp is legal wouldn’t you produce that instead of trying to get an actual child in your child porn images?

Well, Zebra, the major American porn houses (Vivid, VCA, Wicked, etc.) do not touch child porn with a 10-mile pole as it is, and they are unlikely to get into it, “no real child = no child porn” rule notwhitstanding. Why do I believe so? Because the ruling does nothing to remove the possibility that you may get hauled to court for pandering obscenity – which has that pesky “community standard” element to it: you wouldn’t want to bet the business (and jail time for yourself) on some hometown jury seeing things the same way as the team at the CG studio in West Hollywood.

They’ll likely stick with the “barely legal” schtick (late teen). At best they’ll once again produce porn where the girls are supposed to be “in High School” though they look obviously thirtyish. :stuck_out_tongue:
Photo-manipulation of real children’s pics would remain illegal,since you do have an actual minor involved, and having altered the image does not change that.
