Yeah, they had an administrative warrant. She asked for a judicial warrant. They presented none. I mean, if she actually enabled his escape, I’m not sure if that’s appropriate, but jailing a local judge over this just seems insane. ---

She sent the guy out a different door which led him back to the public hall where the agents were waiting. If she was enabling his escape she did a terrible job at it. ---

I think the judicial vs. administrative warrant is a long running issue with ICE - there was a news story in my city recently about local police and correctional facilities refusing to turn over prisoners on a administrative warrants and insisting on judicial warrants. They are probably trying to send a message to lots of people in local law enforcement with this arrest. ---

It’s been an issue for a very long time, at least ten years , probably more. One of the issues with sanctuary cities is that ICE wants jails to hold people past their ordinary release date based on administrative warrants ( or even a “courtesy hold ” with no warrant) and some cities /states will not hold someone without a judicial warrant. ---

This has been an issue here in NC for a while. A number of sheriffs have publicly stated that they will not cooperate with ICE requests to hold people based on administrative warrants, which of course has led to attempts to pass laws requiring them to do so. I think there’s one in the state legislature now, and there’s some question about whether the governor might veto it if it passes. I’m waiting for ICE to start doing random raids on local jails where they suspect prisoners they want are being held. ---
