Not really. In the absence of explanations from the justices or other Supreme Court insiders, bare speculation is all we have. It may be that they’re uncomfortable tackling the issue, it may be that they’re satisfied with the circuit court interpretations, it may be that they don’t think the issue is important, it may be that the lawyers write really boring cert. applications, and it may be any combination of the above.
Don’t be obtuse. That is not the same meaning of “decide” that I was using. A judge “deciding” a case is not the same meaning as a person “deciding” to pay his bills.
Right. I just wanted to make sure there wasn’t some other argument being implied that I was missing. Because I definitely don’t see as how a decision by the current administration as to when and where to prosecute puts anything “to bed”.
