Except it’s not. Obviously he’s never going to face federal charges but the state is completely entitled to prosecute him, it is looking like they will:

The complication is the case will likely end up being prosecuted in a federal court, by state prosecutors. But that doesn’t doom it as long it doesn’t end up before an Aileen Cannon style judge….
However as if this is prosecuted by the state (the only way it is reasonably going to be prosecuted under this administration), it will likely be decided on whether his actions were “necessary and proper” as a federal officer. IANAL but I imagine a federal policy saying in black and white that DHS officers cannot do anything like that is pretty good evidence they were neither necessary nor proper.
Here’s a stillshot of the woman smiling at the shooter and saying “That’s fine dude. I’m not mad at you” about 20 seconds before he shoots her in the face three times point blank and calls her a fucking bitch.
And just a reminder that this “domestic terrorist” had her kid’s stuffies in the front seat next to her.
See, that statement contradicts what had been said about her previously, i.e. that she was there as a peaceful observer.
I have now heard contradictory accounts coming from people who oppose Trump and the shooting. I do not know which one is correct.
Investigations need to be made and questions like this one clearly answered. Nothing is simple, just because it’s recorded on camera. We need the facts to be clearly established to prosecute the killers.

As I think I said before, ISTM that the fact that the other two LEOs weren’t fearing for their lives, and didn’t apparently believe that Ms. Good post a serious threat to others hurts the shooter’s case dramatically.
And even after another 100 posts, I am still being quoted for a fairly mild post that disagreed, slightly, with the common SDMB view. I wasn’t even trying to argue, but it will be allowed to continue, with reenforcement from the moderators. People wonder why this board is in such deline.
