Except it’s not. Obviously he’s never going to face federal charges but the state is completely entitled to prosecute him, it is looking like [they will](https://thehill.com/homenews/state-watch/5680312-fbi-rescinds-cooperation-minnesota/):

> Hennepin County Attorney Mary Moriarty on Thursday said Minneapolis officials will launch an independent probe into the [fatal shooting](https://thehill.com/homenews/state-watch/5676754-minneapolis-ice-shooting-walz/) of a local woman while she was in her car

The complication is the case will likely end up being prosecuted in a federal court, by state prosecutors. But that doesn’t doom it as long it doesn’t end up before an Aileen Cannon style judge….

However as if this is prosecuted by the state (the only way it is reasonably going to be prosecuted under this administration), it will likely be decided on whether his actions were “[necessary and proper](https://slate.com/news-and-politics/2026/01/is-minneapolis-ice-shooter-immune-state-prosecution-supreme-court.html)” as a federal officer. IANAL but I imagine a federal policy saying in black and white that DHS officers cannot do anything like that is pretty good evidence they were neither necessary nor proper.

Here’s a stillshot of the woman smiling at the shooter and saying “That’s fine dude. I’m not mad at you” about 20 seconds before he shoots her in the face three times point blank and calls her a fucking bitch.

And just a reminder that this “domestic terrorist” had her kid’s stuffies in the front seat next to her.

See, that statement contradicts what had been said about her previously, i.e. that she was there as a peaceful observer.

I have now heard contradictory accounts coming from people who oppose Trump and the shooting. I do not know which one is correct.

Investigations need to be made and questions like this one clearly answered. Nothing is simple, just because it’s recorded on camera. We need the facts to be clearly established to prosecute the killers.

Maybe she dropped her kid off at school, and then went to be a peaceful observer?

A woman surrounded by masked, armed men who have no law enforcement authority over her has every right to try to escape. Video shows her steering wheel is turned to the right, clearly an attempt to leave WITHOUT hitting anyone and steer clear of the officer standing towards the front of her car. That officer had time to step to the side, which is where he was when he shot her.
> >
> > Even a real police officer would not have the right to shoot at her for trying to flee. This is well-established in the case law; deadly force may not be used simply to prevent someone from getting away. Given that the ICE officers had no law enforcement authority to begin with, AND the video footage shows she was trying to escape a perceived threat, not to kill anyone, the crime is all the more inexcusable.

We all know the dramatic leanings of the current SCOTUS, but – for those who have interest in these sorts of things – two cases that seem relevant in this situation:

> **[Tennessee v. Garner](https://en.wikipedia.org/wiki/Tennessee_v._Garner)**

> Tennessee v. Garner, 471 U.S. 1 (1985), is a civil case in which the Supreme Court of the United States held that, under the Fourth Amendment, when a law enforcement officer is pursuing a fleeing suspect, the officer may not use deadly force to prevent escape unless "the officer has probable cause to believe that the suspect poses a significant threat of death or serious physical injury to the officer or others."
> It was found that the use of deadly force to prevent escape is an unreasonable s...

> **[Graham v. Connor](https://en.wikipedia.org/wiki/Graham_v._Connor)**
>
> Graham v. Connor, 490 U.S. 386 (1989), was a United States Supreme Court case in which the Court determined that an objective reasonableness standard should apply to a civilian's claim that law enforcement officials used excessive force in the course of making an arrest, investigatory stop, or other "seizure" of his or her person.
> Chief Justice Rehnquist once again rejected the idea of §1983 as "a source of substantive rights". The Court ruled that excessive force claims in the context of inv...

As I think I said before, ISTM that the fact that the other two LEOs weren’t fearing for _their_ lives, and didn’t apparently believe that Ms. Good post a serious threat to others hurts the shooter’s case dramatically.

Regardless of where this does or doesn’t end up.

What difference would it make, given that it is perfectly legal to observe and film law enforcement?

And even after another 100 posts, I am still being quoted for a fairly mild post that disagreed, slightly, with the common SDMB view. I wasn’t even trying to argue, but it will be allowed to continue, with reenforcement from the moderators. People wonder why this board is in such deline.

If you want to complain about moderation, do it in ATMB. Stop doing it in this thread.
