Note that the Diamond Multimedia case applies only throughout the Ninth Circuit which includes several western states. A similar case arising in, say, Ohio or Virginia could lead to a completely different legal result.

True, but it is now a precedent. I think it’d be easier rather than harder to get the same decision if it was brought up again in a different circuit.
