The Supreme Court and the Trump Administration

Or, he accepts that he lost, but simply claims he won, and moves on to another distraction.

Well, but that’s the situation we’re already in. He got an order to comply; he made some ambiguous noise about it and is ignoring it. If the Supremes follow up with another order and he reacts the same again, it’ll just prolong the existing dilemma. You don’t honestly think this Schrodinger’s Democracy will persist forever, do you? At some point the Supremes will have no choice to either challenge him or capitulate. And as you said yourself he’s deliberately pushing on this, creating the crisis that leads to the clear outcome.

I don’t see how this lingers. The inflection point is imminent. Weeks, at most.

Any possible consequence will be buried under the weight of revisionist history.

I had missed the momentous occasion where they started doing Article III stuff again. Have they ruled on the court fees thing yet?

Anyways,

Okay, it’s the BBC and I didn’t know SCOTUS rulings mattered for shit in the UK. Yet anyways, a sign of how they will green-light just about anything you can afford to challenge Trump on.

The UK has its own Supreme Court, you know.

Dag-nab-it. I knew there was a high court yet did not know they were called “Supreme Court”.

Also didn’t know this trans issue was "“in-play” here in the UK. So it was some group who brought the lawsuit and I suppose if Parliament by a majority chooses, they can make a law to right what looks to be a wrong (If Trump wants it, it’s usually wrong) and what real harm was there?

Thanks for fighting my ignorance.

The British press has seemingly had a hate-boner for trans people for years in a way that would make the Republican party envious. And She-Who-Must-Not-Be-Named has deep pockets and has been funding a lot of anti-trans stuff in Britain.

AIUI, the British Supreme Court doesn’t have the same power of judicial review that the American one does and it can be overruled by Parliament, so perhaps some future government will come to its senses.

7-2 ruling issued at 1:30 AM to block further deportations under the Alien Enemies Act. Thomas and Alito dissenting.

What do you mean, if?

People are being scooped off the streets and sent to prisons in foreign countries with no hearing, no evidence presented, no oversight whatsoever. That violates any number of the guarantees in the Bill of Rights.

While this is a good development it just means this goes back to the 5th Circuit. Once the 5th issues a decision they can still appeal it to SCOTUS. They know they already have 2 votes from the dissenters to be allowed to keep up this deportation action. Only 3 more needed to send them all to foreign prisons with no due process.

And of course, there is nothing to prevent DJT, Homeland Security and ICE ignoring the court ignoring the Courts directions and continuing to deport these detainees.

This is true, but it is a positive that the Court saw fit to issue an order that the detainees cannot be removed from the U.S. without their rights to due process being exercised. Even though the matter is before the Fifth Circuit, and may end up in the SC’s lap, they stayed up late on a Friday night to make it clear to the executive that they meant what their order of two weeks ago said. If they were in the tank for the administration, they could have done nothing and then said “Ah, well…” once they detainees were spirited out of the country.

Yes. The courts alone are not going to save us. But this is still a positive development.

As I thought I was saying, yes, this is a good thing. It gives one hope there is a majority that would say deportations should stop without any due process. But, I have been surprised and disappointed by this Court before.

No matter what the Court ends up deciding, any ruling telling DJT and his minions to stop the deportations is a toothless ruling. There is no mechanism to actually stop these slimeballs from ignoring the Court and continuing deportations.

I’ve seen some speculation that the fact that they issued the ruling at 1:30 AM, and didn’t give Alito time to publish his dissent, suggests that Roberts is getting SERIOUSLY fed up with Trump’s shit.

It’s a challenge

The Supreme Court unanimously ruled that the government should facilitate bringing back Mr Ábrego García, but the Trump administration has said he will “never” live in the US again.

“facilitate” - such a scathing harsh word. It sternly implies asking permission when trump has a chance, please with sugar on top?

Can the Marshall Islands or Puerto Rico count? Did SCOTUS say they can’t just lock him up anywhere in the US? Oh, but then he’d be living in the US.

“Leave the gun. Take the Cannoli.”

I’m thinking we’ll see something from Alito like

These actions are so clearly unconstitutional that there’s no way to spin it that wouldn’t make us look like lunatic circus clowns. But last week we let the constitution win and Clarence’s back is hurting from sleeping in the couch all week and he’s almost out of Percocet, and Martha threatened to put my ass on one of her flagpoles and hang it in the front yard, so we’re going to dissent because we like living indoors and our wives are crazy and it’s not like the rest of you are going to let him do it anyway.

Splendid! When their “rulings” defy and are ignored by trump they can go to impeach.gov. On the first page In the pertains to pull-down they can select Article II, solve the Captcha (in the grid click - chosen randomly, you’ll be prompted to select only parts of The Constitution, Declaration of Independence or Magna Carta), then check the box for “Impeach President” and in the notes area be sure to write in “Did not facilitate any of our requests.”

Enter your reply-to email, wait for the confirmation code to be sent to you, and enter that in the “Confirmation Code” input.

Check the "I realize my submission is anonymous though my IP and email address have already recorded for security measures " checkbox and that will un-disable the gold background button with red text that says “Submit” just below.

If you’ve done all correctly, you’ll see an on-screen prompt: “Thank you for bringing your concerns to our attention. The DOGE team will reply in 10-100 days.”

Yep. But until court challenges are decided and appeals exhausted, and either final decisions supporting the action or unfavorable final decisions being defied, the ball game isn’t over.

The admin complied.

Here is a link to Alito’s dissent basically saying it was premature for the Court to act.

For anyone who didn’t already think he’s a useless piece of shit this should remove all doubt.

I just wanted to see if it was true that they didn’t need his follow-the-leader vote to rule on this.

“In sum, literally in the middle of the night, the court issued unprecedented and legally questionable relief,”

“literally in the middle of the night” - such eloquence. And good if I read him correctly, he’s in a bit of a tiff for not joining in which Thomas, even when present, does by default (99+% of the time concurring with Roberts)

I reckon he was hepped on on goofballs.
