That hasn’t been settled, and the main reason it hasn’t been settled is that no previous President has been this clearly batshit pizza. Remember all that crapola about the “unitary executive” back when GeeDubya was the worst so far? The extravagant notion that those so-called “checks and balances” actually inhibited the powers of the executive in some important way? Its pretty simple, really. When the Forces of Darkness hold the Presidency but don’t have a firm grip on Congress, then the Executive branch is clearly sovereign above the others, and always has been, because the Constitution. When they’ve got the Congress, but not the Presidency, it becomes perfectly clear that the Executive branch is very sharply curtailed and controlled, and _that_ has always been true, because the Constitution. ---
