# This is what's wrong with the White House. . .

Interesting. Particularly so because the [Irish gunmaker Rigby](http://www.robbreportcollection.com/Articles/Arts-Home-Decor/Furnishings/Collection-Gift-Guide-Presidential-Sweet.asp) once made a shotgun for Dubya’s father which had the Official Seal of the President of the United States engraved on it. You can order one of these guns for yourself if you wish - only $42,000.

Isn’t there basically an idea out there that if you have some sort of copyright or trademark, and you don’t enforce it, it will become sort of public-domain?

Nope. Use of the official Seal of the President of the United States in commercial ventures is prohibited by [18 U.S.C. § 713](http://www4.law.cornell.edu/uscode/search/display.html?terms=seal&url=/uscode/html/uscode18/usc_sec_18_00000713----000-.html)

Speaking of the White House domain, did they ever fix that little glitch with White [House.com](http://House.com) being a prOn site? Oh, doing a little search, I see they have. Too bad. Now _that_ was funny.

Now, I’m not a scholar of such things, but IIRC, in damn near every TV show/Movie I’ve ever seen where they have a “President” of the US, there’s the seal where one expects it to be. Do we need to re-issue _Superman, Dave, Mars Attacks, An American President_ and issue cease and disist orders to _The West Wing_ and the new one (with Geena Davis as Pres)?

I was thinking the same thing. I remember a tabloid TV episode explaining how they digitally added the seal to an airplane to resemble Air Force One. I’d be really curious as to what their response to this is.

Well, consider. Apparently some people believed the Onion’s story about 6 year old Harry Potter inspired Satanist. And these people are Bush’s core constituency. Is it a wonder he’s concerned? Right now they’re preparing for the invasion of Spain.

I don’t think I can roll my eyes hard enough to convey my feelings here.

Do you guys really think the White House did this because they had no sense of humor? That they did it because associate White House counsel Dixton gets up every morning and dreams of ways to piss off whoever he can however he can?

The guy’s a lawyer, and he’s a bureaucrat, he’s following procedure. I don’t know what else you expect from a government lawyer. Believe it or not the government and it’s agents actually do take a lot of those little picky regulations seriously, and they do make a good faith effort to enforce them.

The law is clear in this issue, and it’s not the first time the issue has come up. And Bush isn’t the only President that does this kind of thing, in fact Bush probably didn’t even know it was going on, this is too small for the President. I’m sure the counsel’s office just caught wind of it, and like any dutiful group of lawyer’s they informed the party involved that, “basically” they were violating the “trademark.” Eventhough the seal isn’t a trademark per se, since it’s actually more protected than trademark and it as well as other government seals are covered under a specific act of congress.

All the onion had to do was request permission to use the seal and I’d say there’s actually a good chance they’d get permission as the White House traditionally hasn’t been too picky about it.
