I confirmed with a California Superior Court Judge (my brother) who said they can absolutely make you surrender your passport a condition of bail. Whether they did so in Trump’s case is anyone’s guess. He owns a plane and can secretly fly out of the country if he needs to. I doubt they would shoot him down even if the feds found out.
It’s not confiscation. It’s a request. Remember, the state is under no obligation to offer bail at all. If they do offer it, they can ask for whatever conditions they want for it. You have the option to turn down the conditions they ask for, and just wait in jail.
I’m actually somewhat reassured by the fact that he has a USSS detail. If the time comes when a judge orders him to do something and he refuses, the judge can then order his guards to bring him to court - with his heels dragging in the dust if necessary.
They’d better. They are Federal officers bound by oath to preserve, protect and defend the Constitution. I’m sure there’d be appeals and arguments, but at the end of the day, the rule of law includes the obligation to obey lawful court orders.
