CNN sez the arraignment will be at 2:15 Eastern time, so lots of bloviating by reporters about “unprecedented” etc for a few hours.

I don’t like to rub salt in a wound, but…just above the headline (admittedly in much smaller type), it says “Satire from the Borowitz Report.”

The most extreme thing in this case could be home confinement with no access to internet or even phone, perhaps. Because he’s the leading Republican candidate for president, the line to walk is a tough one for the judge.

Another thing that could happen is for the Manhattan DA to lodge additional charges based on Trump’s threats.

No orange jumpsuit, I’m afraid.

I’m more concerned about what will happen if a gag order is issued, Trump returns to Florida and ignores it, and then ignores the judge’s summons to return to court based on the gag order violation.

With DeSantis’s promise to not cooperate with an extradition, things could get ugly fast.

Re the judge, good judge with an excellent reputation. Even Trump’s lawyers have said so.

This is my question as well. What power does a Governor have in a case like this? What is he going to do, send in the Florida State Police to interfere with the Feds? Or, is Mr DeSantis just posturing for the rubes?

This case isn’t the Feds, though. It’s New York. Specifically, Manhattan. They will need cooperation from Florida law enforcement to facilitate an arrest in Florida.

The question is to what extent DeSantis is willing to violate the Constitution in these matters. I don’t know how tight his control is over Florida law enforcement.

From the Wikipedia article [Extradition law in the United States](https://en.wikipedia.org/wiki/Extradition_law_in_the_United_States)

> [@](#):
>
> In _[Kentucky v. Dennison](https://en.wikipedia.org/wiki/Kentucky_v._Dennison)_,[[2]](https://en.wikipedia.org/wiki/Extradition_law_in_the_United_States#cite_note-2) decided in 1860, the Supreme Court held that, although the governor of the asylum state had a constitutional duty to return a fugitive to the demanding state, the federal courts had no authority to enforce this duty. As a result, for more than 100 years, the governor of one state was deemed to have discretion on whether or not he/she would comply with another state’s request for extradition.
>
> In a 1987 case, _[Puerto Rico v. Branstad](https://en.wikipedia.org/wiki/Puerto_Rico_v._Branstad)_,[[3]](https://en.wikipedia.org/wiki/Extradition_law_in_the_United_States#cite_note-3) the court overruled _Dennison_, and held that **the governor of the asylum state has no discretion in performing his or her duty to extradite** , whether that duty arises under the [Extradition Clause](https://en.wikipedia.org/wiki/Extradition_Clause) of the Constitution or under the [Extradition Act](https://en.wikipedia.org/wiki/Extradition_Act) ([18 U.S.C.](https://en.wikipedia.org/wiki/Title_18_of_the_United_States_Code) [§ 3182](https://www.law.cornell.edu/uscode/text/18/3182)), and that a **federal court may enforce the governor’s duty to return the fugitive to the demanding state**.[[4]](https://en.wikipedia.org/wiki/Extradition_law_in_the_United_States#cite_note-4) There are only four grounds upon which the governor of the asylum state may deny another state’s request for extradition:[[5]](https://en.wikipedia.org/wiki/Extradition_law_in_the_United_States#cite_note-5)
>
> 1. the extradition documents facially are not in order;
> 2. the person has not been charged with a crime in the demanding state;
> 3. the person is not the person named in the extradition documents; or
> 4. the person is not a fugitive.
>
> There appears to be at least one additional exception: if the fugitive is under sentence in the asylum state, he need not be extradited until his punishment in the asylum state is completed.[[6]](https://en.wikipedia.org/wiki/Extradition_law_in_the_United_States#cite_note-6)

So, DeSantis has to be willing to defy a Federal Court order to refuse Trump’s extradition.

Here is an AP article about him:

> **[Who is Juan Merchan, the NY judge handling Trump's case?](https://apnews.com/article/trump-indictment-new-york-judge-merchan-arraignment-032a097661c259709a948ce0e70a872a)**
>
> New York Judge Juan Manuel Merchan has presided over criminal cases against former President Donald Trump’s company, its former finance chief and one of Trump's former White House aides. Now Merchan is poised to take the historic hush-money...

One thing to note is that he is Colombian, which may not be that relevant given he moved to the US when he was 6; however, Judges in Colombia have in many cases not been intimidated by threats to their life by Drug Lords, Guerilla Groups or the Military so if he is in that vein I don’t think Trump or his supporters will faze him.

> If there’s DNA evidence on record in this case, what happens when Trump’s DNA hits the database after tomorrow? There was speculation that he’d send in fake DNA in the above case, but he can’t pull that off when it’s an official sampling being done.

The E Jean Carrol case is a defamation lawsuit between private citizens, not a criminal charge by the government.

I’d assume that it will make it easier for Carrol to gain access to the DNA than by asking for it straight from Trump, but I would expect that it’s a more complicated process to request it than if she was a police officer working a separate case against Trump.
