I’ve been trying to learn about this myself, and I think the answer is “imminent harm.” It’s a very nebulous concept but the speech in question must have the potential to cause immediate harm in order to count as incitement to violence. When I refer to the USA as a “dumpster fire” or a “shithole”, I’m not doing so in an off-the-cuff or merely trollish fashion. These are honest expressions of shock and disgust. I was born in New York and spent the first 35 years of my life in America. Never, while I was growing up and then going on to college, did I think that I would voluntarily leave the country of my birth. Hell, I _loved_ the place when I was younger. So much so that I prepared to be a high school social studies teacher, to inculcate in the next generation what I thought were the best of American values: justice, fairness, compassion, opportunity. Then slowly, bit by bit, things began to change. Several unpleasant encounters with law enforcement showed me that my idealized, “Civics Class” conception of how law and order were actually practiced was painfully naïve. Seeing my father forced out of work after decades of productive employment without a dime in pension showed me the hollowness of platitudes about “hard work” being rewarded. When my sexagenarian mother had to go out and work for a pittance in order to pay the medical bills after my father’s heart attack, and also so that the town would not seize their home for unpaid property taxes, I clearly saw that I myself had little prospect of security in my dotage. And when I saw the incompetence and apathy of government in delivering relief to the survivors of Hurricane Katrina, I lost any remaining faith in the prospect of a functioning society. That was the last straw. I left for Ireland four months after Katrina, and have never regretted my decision. I never want to return. I’m telling you all this so you know where I’m coming from. America broke my heart in the years before I left. And as bad as I thought things were in 2005, to see the sickening disaster that’s unfolding every day of this administration, is breaking my heart anew, all over again… ---

That’s sad. I’m sorry to hear that. For all its problems, I love this country and want to stand by it. At this point, it’s also like I have an ethical obligation to stay and stand up for people who can’t just leave. If all the good people left, this place would be really fucked. Part of me does still love America - if that wasn’t the case, the news probably wouldn’t bother me so much. Plus, it’s where my remaining family and most of my friends are. I do find myself, in a weird way, kind of wishing I was still there, just so I could find an outlet for my “righteous” anger. Had I remained, I’ve no doubt I’d be socially active in joining other people to fight the good fight. From what I’ve seen on these boards over the years, you also seem to be one of those people.
