Fox news is saying the mandate has been upheld, not under the commerce act but as a tax. Looks like CNN got it wrong.

AP and CNN reported opposite outcomes on Twitter. Ooops. I wish they would wait a minute or two, and be accurate, rather than first.

CNN is saying the mandate survived as a tax, and the rest of the law is being upheld. If that’s the case, it seems like pretty much everybody would get what they wanted, right? The law stands, it loses the name “mandate”, and people are taxed if they don’t have medical insurance. The only losers are the insurance companies.

The insurance companies aren’t losers. The law will push a significant number of people into the market.

My argument was that Congress did not have unlimited powers to force you to buy broccoli or healthcare insurance. The USSC did not uphold this law based on the commerce act. Congress can not force you to buy broccoli.

The USSC ruled that this is a tax and as a tax, it falls within the powers of Congress.

It will indeed, but not at the full saturation the industry lobbied for at the drafting of the legislation.

You said the law was unconstitutional, and it isn’t. It’s not as though the tax argument cropped up out of nowhere.

Also it’s the mandate that is politically unpopular, not the Medicaid expansion.

That’s not quite the issue. Under the bill as passed, Congress didn’t have to actually give the states any additional money. They would have, but it wasn’t guaranteed, which is why lots of governors and attorneys general complained about the unfunded mandate.

Oh I see. I thought the complaint was that states would have to pitch in part of the funding like they do for the current program.

Not quite. CNN AND Fox (and you) all called it too fast, without reading the whole thing. The humiliation of cable news was worth all the fuss. Who watches that crap?

My understanding about the Medicare thing was that the Feds could pull ALL Medicare funding if certain conditions weren’t met, per the ACA. It was meant as an incentive to get the states to take the expanded Medicare money. The Supreme Court basically said no to that.

Hahahaha. I gave reasons for my opinion. The actual ruling seems to have surprised a lot of people. I’m one of them.

Five Justices ruled that this is a tax and Congress does have the power to tax. That is NOT how the Progressive Democrats and Obama sold this bill to the public. Of course, it’s not fraud - it’s politics.

I can see where some people will be saying that Obama said he wasn’t raising taxes when he was, in fact, raising taxes.

Hahahaha. I was watching CNN when they had their “Dewey wins” moment. I changed channels and saw were Fox reported the exact opposite.

It turns out that CNN screwed up.

The Obamacare Tax will now become a major issue in the upcoming election.

Well, an issue, I suppose, since that’s about all you have. “Major” will be a matter of perspective, I’m sure.
