Question : has ICE been sued into bloody hell for all those excesses? It really seems (to a person abroad) that there is no rule of law with this regard in the USA ---

There isn’t, you are correct. This is what American Republicans wanted and voted for. And as far as lawsuits go, no one in this administration is going to bring any criminal charges. Civil lawsuits are happening courtesy of the ACLU. But these individual agents are literally covered up and difficult to identify. As for monetary payouts, it’s like the Chicago police do: settle the suits with staggering numbers of taxpayer dollars. None of it comes out of their personal pockets, they don’t give a shit. ---

But there are many lawsuits, just a Google search comes up with many. A lot are class action suits due to the wide overreach of the agency and the number of people victimized. ---

Individuals need to be sued, and found guilty of illegal condust or contempt of court. To do that, states need to pass “ID” laws. Police officers, including ICE, ought to be required to have their ID visible on their uniform. It doesn’t need to be a name that you can google, but it needs to be a unique identifier that your lawyer can force ICE to connect to a particular person, who can then be charged with crimes. ---

It kind of defeats the point of a secret police if they aren’t, you know, kept unidentifiable. At best some very blue states might pass laws attempting to force identification but ICE has no obligation to follow them. ---

If nothing else, ICE should be required to have their unit number on their uniforms. It couldn’t be used to dox them, but their unit commander could be held (somewhat) accountable. ---

Read your policy to see if “police activity” is excluded. It probably matters if the person driving the car was doing anything illegal at the time. If it was a US citizen falsely grabbed without time to cooperate, that would be handled differently than an illegal alien trying to escape. I haven’t read the policy forms recently enough to remember, but my gut feeling is that if you have phys dam other-than-collision coverage, and are not committing a crime, the damage would be covered, and otherwise it wouldn’t be. You might have a better shot at recovery if someone filmed the interaction. ---

So in the situation above , it seems like insurance company will probably refuse saying it was law enforcement related. ---

No, i don’t think law enforcement is an exclusion. Act of war is excluded. But i don’t think police activity is. Except i haven’t checked in decades. Like, i think that if a police car was involved in a high speed chase, the driver slipped, and smashed into your parked car, that would be covered under “other than collision”. In that case, you might or might not also have a liability claim against the police, but they might be protected from liability, in which case your OTC policy would respond. So i think if ICE assaulted a US citizen or legal resident, and damaged their car, and the owner of the car was not found to have done anything wrong, that same OTC policy would respond. But you might have to prove you couldn’t have avoided the damage by complying with ICE demands. ---

I saw a pod cast interview with a woman who honked as a warning that this was ICE in the SUV next to her on the highway. He rammed her car. She had to stop. He pulls her out if the car and shot her 5 times. Made 7 holes and bragged about it on his social media. He was brought to court. I wonder if it’s true. As it was late at night the particulars are fuzzy. She lived because they were interviewing her. I don’t know the outcome of the court case because I fell asleep. Yeah…gonna go find it again.
