various motions on the chesebro and powell trial. first up was a list of unindicted co conspirators, it was ruled that the list would be given to defence with a protection order on release of the names. second is transcripts of the grand juries, regular and special. they are arguing that now. as chesebro is accused of perjury his team is arguing for full disclosure. the prosecution is arguing for limited disclosure only pertaining to the perjury. ---

it has not been named as yet. this judge is good. he is looking ahead to the trial and looking for delay pitfalls. ---

powell’s attorney is requesting written responces to defence motions. oh, he is getting combative. judge will rule later on grand jury transcripts. now the lawyers for chesebro and powell are seeking to speak with the grand jurors. arguments on this motion are being heard now. ---

apparently, it is. the judge just said that the defence could. the judge is asking for guidelines on what they could ask them. the defence is saying they need to speak to them to determine that the grand jury was independent. the judge isn’t buying that argument on the face of it. ---

Why speak to the grand jurors? Intimidation (for future jurors), discover/invent (independence as a code word) prosecutorial malfeasance, and look for an angle or argument that would influence the trial jury. ---

the defence is trying for proof that the grand jury acted improperly. on motion 1, the judge is asking for follow up and sites for the grand jury questions. on motion 2, transcripts of grand juries, later ruling. on motion 3 the list of unindicted co conspirators will be given to defence with protection order. jury selection will be discussed later this month, craft a list of questions for that. judge is looking at first week of november to swear in the jury. bit of discussion on how to deal with trial timing and scheduling. ---

and done. team chesbro seems to be trying for improper grand jury. that the prosecution rigged the jury. team powell seems to be trying for coffee county was not her circus, not her monkeys. there appears to be some tripping points with the defence lawyers with federal vs state. federal no way, no how, would anything from the grand juries be released or questions. the state has a bit more slack. ---
