Many employers choose not to exclude pre-existing conditions, or only exclude them for some period of time. So there is still cause for optimism. But I believe the main legal protection for not excluding pre-existing conditions applies to people who are switching from one insurer to another. It is called “prior creditable coverage.” If you are considering multiple employers with benefits, it might be worth discretely investigating each employer’s policy about pre-existing conditions.
