What is the Logic Behind 'Strict Liability' Crimes?

Amusingly, this can happen. Certain popular models of foreign car are so common, and the key tolerances so loose (like 90s era Hondas) that you could get into someone else’s car and drive away with it without noticing. I mean, it’s only marginally theft…more like a car swap between 2 almost identical vehicles.

That makes me wonder : if you and I have 2 identical, expensive items. Say it is 2 new in box iphones. And I swap “my” iphone with “your” iphone. They are identical in every practical way except serial numbers. (no contact data is on either)

Is this theft?

I think most people would be suspicious of this ( and consider it theft). What if my “new” iPhone is buggy? Did you somehow know that was to be the case, causing you to make the swap?

I’m sure most prosecutors would yawn. Go talk to Apple. No real harm done to me, except for time and aggravation. Most of my lost time would be spent in figuring out how to get even with you. :slight_smile:
