Any idea what our procedures are for dealing with (ostensibly) surrendering enemies? I’d imagine a big ol’ M1A1 with its barrel aimed at the troops, personally…

And a little more seriously, shouldn’t there be some “put down your guns and go way the hell over there” aspect to the acceptance of surrender? (Granted, harder to do with several thousand surrendering at once, but still.)

All the US citizens I ever spoke to about the legal system always said the US legal system was the best in the world (you do not want to know my opinion on that) so I cannot imagine them accepting an ‘inferior’ legal system to process claims against US citizens. Besides, so long as Vietnam, for example, could bring claims in such a court for genocide (due to Agent Orange, for example), etc. (I am not saying whether they would or should win or not), there is no way they would accept such jurisdiction. …

United States Constitution, Article 3, Section 2:

> [@](#):
>
> The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the United States, and treaties made, or which shall be made, under their authority;–to all cases affecting ambassadors, other public ministers and consuls;–to all cases of admiralty and maritime jurisdiction;–to controversies to which the United States shall be a party;–to controversies between two or more states;–between a state and citizens of another state;–between citizens of different states;–between citizens of the same state claiming lands under grants of different states, and between a state, or the citizens thereof, and foreign states, citizens or subjects.
>
> The trial of all crimes, except in cases of impeachment, shall be by jury; and such trial shall be held in the state where the said crimes shall have been committed; but when not committed within any state, the trial shall be at such place or places as the Congress may by law have directed.

It’s not a matter of inferior courts. It’s that the Constitution forbids it. Sorry, end of story.

I second what mangeorge said. I applied for the military and flunked the physical; which is probably a good thing, since I would have made a lousy sailor.

That makes me respect our troops more, not less.

Same here. I mean it’s just something I can’t contemplate. The whole thing about if they surrender a second time for real I’m supposed to accept it. They’ve got a lot more self composure than I would in that case and I commend them since it’s the right thing.(Since I would be the type to just obliterate the enemy if they pulled a fake surrender, regardless of what happened afterwards.)

Once the Germans had passed the French lines, they popped back inside and started fighting. The line was quickly broken and the race across France started. \*\*

I would like to see a cite for this. Not only will surrendering forces not be allowed to keep their weapons, Rommel has a reputation for following the rules of war.
