When do baby pictures become kiddie porn?

You know, I just remembered that there’s a picture of me in the bathtub with my dad when I was about two, (no, you can’t see a thing), and I just realize that nowadays, my parents would probably have been investigated for that one.

You should have saved that picture (and the negative) for till now, when you would find it very valuable. “Bring your date home before curfew time, or you & she will both see a copy of this photo pasted to the front door.” Works wonders!

I happen to dislike Anne Geddes’ work, but I don’t think it is offensive.

I think that we can assume that the 16-yo girls were not fully dressed holding a dildo in an unprovocative way and that at least one or two of the definitions Q.E.D. posted were likely true.

I think that when it is wrong depends on the kid. If the kid is OK with nudity until 8, then you should stop taking pictures of him nude when he is 8. If you have an extremely shy 3yo, then stop taking nude pictures at 3. You can tell by how often the kid runs around nude and how carefully they close the door when bathing, dressing, etc. We used to have colored soap ‘body paint’ when I was young and my brother would paint himself then invite my parents in for an art show. He wasn’t bothered. Thalion doesn’t know that until he talks to my brother and my parents. I know there are pictures, I don’t know if those pictures include genitals because that isn’t the point of the picture. It is porn if and only if there is sexual content in the picture.

What about digital pictures? It seems to me that not having to get photos developed makes it easier to get away with taking kiddie porn shots.

What about nudist colonies. Can you never take pictures of the kidlets there because they aren’t dressed? Do you yell “Jimmie, put on some pants, I wanna take your picture” Do you take all pictures from the back?

We do indeed have the incriminating photo, along with adorable shots of the Fem-Bot crawling around the grandparent’s front porch, stark naked. Again, if she was a year she was a lot. She was only crawling and an early walker, and it was summer time. She was born in December so I’d say she was about 8 months old at the time. Very cute photos.

I could be wrong, but I was under the impression that most nudist camps don’t allow anyone under 18. If only to cover their asses…well, so to speak.

While I’ve never been to a “nudist colony” (sounds like you should call Orkin for that!), I do attend “clothing optional” campgrounds and festivals with my family. Everyone is informed, over and over again, that you do NOT take group pictures, pictures of people you don’t know, or even pictures of people you do know without consent.

Do I have a couple of (digital) naked pictures of my kids? Yeah. As infants. WhyKid was not and is not comfortable being nude, so I’d never take a picture of him like that now. WhyBaby’s still a baby, and I have a couple of her in the bath. I even have a couple of pictures of my friend’s kids naked (nothing nasty, but one little girl just doesn’t like to wear clothes, so if she jumps into a picture with my kid, she’s gonna be naked.) Even there, I clear every picture with all of her parents and with her before shutting off my camera. If I can’t find them immediately, I delete the photo. Nothing from behind, as it can be assumed I didn’t have her permission. Nothing candid. Only fully aware shots with permission. And, honestly, this year she started getting curves - nothing big yet, but 11 year old bumps and swellings, and so I am no longer comfortable taking naked pictures of her.

And getting permission goes for adults as well as kids. Not only for naked shots, but any pictures at all.

You are wrong. Some are adult only, but most are family friendly. It’s alawasy been an area of contention within the communities. There are some states where allowing a child to see a nude adult in a non-sexual context is illegal - even if it’s within a family. (So, seeing the naked breast of a woman breastfeeding is not illegal, but seeing the naked breast of a non-lactating woman is child abuse. :rolleyes: ) Right now, most places simply ignore the laws or inform parents that we’re responsible and assuming our own risk. But, in the current socio-political climate, and with concern that Rave laws and the PATRIOT Act may be applied to hippie-fests, there’s a worried current going on that may start to prohibit this in the not-to-distant future.

From my Dutch point of vue, yes. I don’t know of any cases in the Netherlands like these. As far as I know, Dutch police investigates kiddieporn solely on the Internet, tracking peadophiles picture exchange-networks and (illegal) commercial kiddiepornsites. The Dutch police’s implicit philosophy is that if someone intends to make less then innocent pictures, they won’t offer them to a public developer anyway, so efforts are better directed elsewhere. Makes sense to me.

The Dutch have become more cautious in the last 20 years about sexual abuse of children, though. Parents are more cautious of not doing anything that can be misinterpreted as such. I think the general feeling is is that parents and kids being nude together (f.i. bathing) is fine, as long as nobody touches nobody’s genitals, except for the parent washing the kid.
But taking pictures, by the parents themselves, in which the kids are nude is not yet tabooish. And I hope it stays that way.

There was one recent minor incident in this vein though. A Dutch city’s Council had established a nude-beach, and because it was a success, they sent a reporter (who went there with his wife, as an outing, and maybe to be on the safe side) to make some pictures for the councils newletter. There were some nude kids in a few of those pictures, taken from 40 metres away or so.
A guard on the nude beach demanded that the reporter to destroy the pictures because “he was taking advantage of the children in the pictures”. IIRC, the guard was pooh-poohed away, but the reporter chose other pictures for the newletter just to prevent trouble.

hmmmm . . . I don’t really need “other, compelling evidence” to investigate a possible crime.

Once again, the pictures weren’t a problem, but I had to make sure there wasn’t something else going on.

The fact is, once a report (even one with such little support) is made of possible child abuse, I’m required by law to investigate. CYA, pure and simple.

I see that I wasn’t very clear in my original post to this thread. The girls weren’t just posing with the dildo, they were using it on one another. I guess that will teach me to try to be discrete when addressing such issues. :slight_smile:

Looking at the pictures, there was reasonable suspicion that they were minors. I learned their actual ages by identifying them when they came to pick up their pictures.

Ah, yes. HUGE difference. I agree that the law is clear that a photograph such as this is illegal in your jurisdiction, and also under federal law.
