It may be, and probably is the case that if a builder wants to build on a specific location, that part of that must be set aside for affordable housing, but that is a condition of getting a building permit, not a requirement on the builder. If they want to build elsewhere, then they can, without those restrictions. I am currently in a commercial building. As part of building it, they were required to put in a sprinkler system.
