OK, a couple of hypotheticals for all those who believe the child should not be allowed to sue:
If there was a procedure that could fix the birth defects, and the parents couldn’t afford it, would you now believe the child had a right to sue? Assume for whatever reason the parents are unwilling to sue the doctor themselves.
What if the procedure could fix 50% of the birth defects, or halfway correct the one birth defect? Would you agree the child has a right to sue? How much could he or she collect? Enough to cover for ALL the defects or just enough to have the operation?
My viewpoint would definitely change with #1. #2 I’m still deciding.
