She wanted a White child from a Sperm Bank

In this case, an Ohio mother acquired a few sperm vials and got pregnant. Problem is that she says the Sperm Bank sent her the Sperm of a Black man instead of a White man. She’s suing the Sperm Bank for a breach of contract. I say she got a child, and the child is healthy and she loves her child. No injury there.

She is suing to continue her racist ways because she does not like the color of the child’s skin. I can’t see how the court would rule in her favor since she got a child out of the process.

I order a red soccer ball and you sent me a blue soccer ball.

So? You still got a ball.

If it was only that simple. A child is not a soccer ball. :dubious:

I haven’t personally donated sperm, but sperm banks routinely advertise for things like hair and eye color, not to mention overall race. If she paid for a vial of white dude sperm and got a vial of black dude sperm, I think she’d have an actionable cause.

It doesn’t even have to be a racist issue - she could just want her kid to look like herself and her husband… as it says in the first line of the article you linked.

She didn’t get what she requested and, presumably, what she was promised. That alone would give her a case.

If a white person wants to raise a white child, I’m not sure how racist that is. If it is, it’s probably in the same area as choosing a sex partner. It’s an area where one is ALLOWED to be racist.

She ordered it by phone and she did get a baby, except she does not like the skin color.

To be honest though, reading that article kinda makes me wanna puke.

“We’re from an all-white town and we get ridiculed and I have to drive miles away to get her typical African-American hair done.

Who are these people?

If the sperm came from a white man and by a trick of genetics it has darker than usual skin, well, she’s out of luck.

If the sperm bank screwed up, she certainly has an actionable cause and frankly I think it’s a bit silly to blame the woman for wanting to get what she asked for. She didn’t ask for just any baby - she asked for a baby that looks like her and her husband.

Whether she has a legal case or not, this is a very shitty thing to do. It’s very likely that because of this lawsuit, at some point, her child will find out that not only was she “supposed” to be white, but her mother sued the sperm bank because she is not.

That’s a very shitty thing to do to one’s daughter.

Especially considering the child is only two years old. How much hair care are we taking about?

I adopted my dog from a no kill shelter. They said he was half Chihuahua and half miniature Australian Shepard. Bentley tips the scale at 55 pounds now. They got the dog part right though, he’s definitely a dog.

She got a healthy kid, she needs to be thankful for that.

Husband? I thought she was lesbian and has a partner?

From the article

[QUOTE=The Article]

“She carried her daughter Payton for nine months. She has bonded with the child and she loves Payton very much,” her lawyer, Thomas Intili, told NBC News on Wednesday.

I don’t think she’s suing because she doesn’t love her daughter, she’s suing because the sperm bank screwed up…

You keep repeating this as if it had any bearing on the discussion. If you just wanted to express your dislike of her as a person, you should have posted this on a site dedicated to mixed race adoptions and pregnancies and let everyone nod their heads in agreement.

It is true that she got “a child.”. There could be many reasons why she might want the sperm bank to provide her compensation that do not necessarily make her racist. Until you provide a rational argument why she should not have a case in court, you are engaged in nothing more than Recreational Outrage which is better posted in The BBQ Pit.

You’re correct, I was skimming and misread.

Seriously, she should have done it “eye to eye” with the father, not via the telephone.

They are looking for money from a lawsuit. That means damages. They will have to show reason as to why they should get this money. Now, they could say “we dont like n*ggers round these parts” or they could go the “we arent in a mixed community area, this will result in our lovely daughter being denied her heritage and the costs of her haircuts are more expensive than we predicted”.

Adoptions of black kids by white parents have been denied for less reason than this. Well, they have in the UK.

Do you mean the parents deny the adoption or some third-party authority denies the adoption?

Sure, but carry yourself with class. Leave that quasi-racist piffle for the courtroom.

One reason to sue that doesn’t involve racism or anything petty is to make sure the clinic tightens up their policies and quality control. If they’re being careless, and this error is a symptom of their carelessness, they need a slap on the wrist to get things under control.
