The photo in the Smoking Gun story is on the restaurant table, with base and stem of wine glass in view. If there are other photos of it elsewhere, the restaurant wouldn’t reject an accidentally-signed Customer Copy if the customer took the Merchant Copy.
But yeah, it could have been a waitstaff/other restaurant employee joke or hoax gone awry as well.
