A legal related question, but not asking for advice

One of the first things an insurance company tells the driver at fault is NOT to contact his victim or victims family to apologize or express remorse, no matter how he feels, as it could affect any ensuing lawsuit. If the driver hasn’t reached out to you, that is probably the reason.

But no lawsuit has been filed, nothing civil anyway, on my mom’s part.

There most likely will be a lawsuit. If the guy even says “I’m sorry” to your mom, that could be construed into an admission of full responsibility for the accident. The insurance company’s lawyers do not want that to happen.
Also, don’t you have a local newspaper? Most fatal accidents make the news, and give the names of all involved.

My father’s name was in the paper, but the name of the driver who struck him was not released.

There was another article in today’s Capital-Journal. Apparently the accident report has been released. The name of the driver that struck my father is in the article. I also did see a copy of the police report, and found out, ugh, he lives two blocks from me. It was confirmed that the driver was looking down to change a CD, and saw my father too late. Now I’m hurting all over again, and my poor mother has to keep on seeing this brought up in the news.
