There’s also the possibility that they weren’t going to kill her, but kidnap her to force Henry to give himself up to them, or at least not go to the Feds and just take the fall for his drug dealing arrest, or just use her as a bargaining chip with him for something. If they killed her Henry would have had even fewer options and almost certainly would have grabbed his kids and ran to the FBI even faster, motivated by hatred and revenge.

Jimmy was killing everyone with any knowledge of his crimes. She was going to be killed.

Fun bit of trivia: Robert Crumb, the famous cartoonist, married Aline Kominsky, the daughter of two of the (lesser) conspirator/participants. She drew a comic about the idiot scams he perpetrated, like selling faulty or nonexistent alarm systems to his own neighbors. He wasn’t in the movie by name, but all those people who, being told to stash their money and not spend it for a few months, turned around and bought big expensive cars? He was one of them.

Last year I heard that the FBI was digging up Jimmy Burke’s back yard-they found human bones. Anybody know more?

There is no statute of limitations on murder.

As the movie showed pretty much everyone involved in the Lufthansa robbery was killed. I’m guessing as a survivor of all that he gets left holding the bag, so to speak.

It sounds like he’s up on federal racketeering charges, and is being linked to the Lufthansa robbery as part of that. He’s not specifically being charged with the robbery itself. And since one of the links in the racketeering charges is murder, the 5 year federal SOL for racketeering doesn’t apply.

Asaro and his co-defendants are charged (pdf) with conspiracy to commit racketeering. The robbery and the murders are included as elements of the racketeering, not as crimes in their own right.

The government alleges that the conspiracy extended between January 1, 1968, and June 30, 2013, “both dates being approximate and inclusive”. Elements outside the statute of limitations can be included in a conspiracy charge as long as the conspiracy extended to a period within the statute of limitations.

The defendants are also indicted on two separate counts based on more recent actions associated with loansharking.

He’s been charged with conspiracy to commit racketeering violations, basically by being a member of an organized crime family. The Lufthansa job comes in because the prosecution can reach back all the way to the beginning of the conspiracy as long as the end is within the limitations period, and the five-year statute of limitations has not run, because the last predicate act charged as part of the conspiracy was in 2013.

The “code” of the Mafia is routinely broken. It’s mainly there as an excuse to ease the conscience of some people when they order the disappearance of someone.

Goodfellas had many examples of this. E.g., Tommy killing Billy Batts, Henry selling drugs despite being told (and paid) not to by Paulie. Shoot, even Henry testifying against the mob was a big nope.

Sammy “The Bull” Gravano’s rise in the Gambino Family contains numerous examples of him killing/betraying higher ups in the Family so he could advance himself.

While The Godfather made a big deal out of not killing “civilians” (even people like Tom and Michael, before he turned to the dark side), this isn’t true in real life. E.g., the accidental death of John Gotti’s son lead to the murder of John Favara.

Witnesses like Karen Hill could be killed and no one would think twice that this was wrong.

The phrase “Men of Honor” that the Mafioso applied to themselves is ridiculous.

when Tommy was whacked they said it was for Billy Batts and “a lot of other things”

Karen had an affair with Paulie (captain of the crew) During that time Tommy tried to rape Karen. When Paulie found out about the attempted rape he told the Gambinos (Batts family) about Tommy killing Batts which led to Tommy being whacked.
