British “constitutional” law contains no safeguards for the protection of human rights except and in so far as Parliament allows them to exist. I think reading what I can find about the decision, that if Lord Bingham is to be taken as speaking for the majority, the government only needs to increase the scope of its power to include british subjects as well, and it would be legally valid. Not a reassuring victory for human rights there. The House is basically telling the government, that if you increase the scope of the violation, you’re okay, cause then you won’t be discriminating. To be frank I’m suprised that the Home Office lost this one.

The House of Lords also have no power to render legislation void, all they can do is issue a decleration of incompatability and wait for the government to do something about it. The government does not have to if it doesn’t want to, and i suspect this will stay the law pending review and other inconclusive hand waving.
