American Revolution-era art question

In two famous paintings of the signing of the Declaration of Independence (1776) and the Constitution (1787), a collection of flags and drums hangs on the wall. See:

What was this odd bit of decor called? Was it common in the 18th century? Would those be American flags and drums displayed out of patriotic pride, or captured British flags and drums displayed as war booty?
