And a second copyright question for SD lawyers

For good form I’ll add a link to the earlier question that was asked by InquisitiveIdiot, though it has nothing to do with my own question.

Which is this:

I understand that the courts have determined that recording a show off the TV to watch later is fair use. One would assume that also applies to recording off the radio.

Can I turn around and then sell, give, or loan that recording to someone else? Or is that crossing the legal line?

Thanks in advance.

Fair use is for your own personal, noncommercial use. You cannot sell your copy, nor copy it for distribution to others.

I believe that you can lend or give away the one copy so that it is only in one person’s possession at a given time.

I refer you to my second post in this previous thread.
