In my walk in a local park, I noticed a situation that looked dangerous to me. We had a hurricane two weeks ago, and several trees had fallen-they were propped p gainsta other trees. One in particulat straddled a walking path-it looked dangerously unstable-a slight breeze, and the tree trunk would crash to the ground-crushing anything below it.
My question: would the city be liable in case of such an accident? Or does the doctrine "use at your own risk) apply?
