Arrest Warrants

When there is an Arrest Warrant issued for you (I/E Michael Jackson), Couldn’t you be arrested where-ever you are in the world and extridited to where the Arrest Warrant was issued? Why can Michael Jackson negotiate where, when, etc. he will give himself? Is it because he is a known person-celebrity?, because I am sure the average person who has an Arrest Warrant would be arrested where-ever they are, and extridited where the Arrest Warrant was issued.

Not anywhere in the world. There are countries that will not extridite. And others that will not extridite if they think we might execute the criminal.

As far as calling and negotiating a time/place for a surrender: this is not so unusual. You don’t have to be a celebrity or anything. I’ve heard of people being informed by their lawyer that there was an arrest warrant out for them, and then they make plans for the person to turn himself in. Also, peole who know there is an arrest warrant out for them can always call a police station and make arrangements for a surrender.

It’s a lot easier to work with a fugitive suspect and his representatives to negotiate a surrender than it is to go through the process of having the fugitive extradited. Prosecutors would much rather wait a few days for the fugitive to surrender voluntarily than incur the costs of time and money of an extradition.

From the press reports, it sounds like the arrest warrant was issued under California law. Mr. Jackson was in Las Vegas at the time, filming a tv special. The California warrant doesn’t have any legal force outside California, unless there’s extradition proceedings under Nevada state law. So Mr. Jackson could wait in Las Vegas until there’s extradition proceedings, or he could negotiate to turn himself in voluntarily in California.

According to MSNBC Las Vegas police told Santa Barbara that he was there and they asked if they wanted them (meaning the LV Cops) to arrest MJ. Santa Barbara police said “no” they were arranging a “surrender.”

It makes too as MJ got a lot of sympathy just for being handcuffed. Can you imagine what sympathy he would get if he was rushed and attacked and handcuffed.

A lot of criminals (note: al capone) have arranged to turn themselves in on their terms.

I think Jay Leno (gasp!) said it best the other night:
“If your name is MICHAEL Jackson, you get to negotiate your surrender. However if your name is TYRONE Jackson…” and he starts miming like a cop is cuffing a perp, roughtly taking him into custody and dragging him off.
