I am a W2 employee so in a case like you describe it would fall on the employeer. but I have been involved in law suits where plaintif’s expert witness admitted that the fault laid with a family member of of the family that was suing. And still the family got $80,000 out of it.
another case that I could have been involved with when a kid lost a few toes, the family’s lawyer did not know what questions to ask. So they never asked me any questions. Never heard what the family got but it was not in the millions it should have been. the employeer was luck because the lawyer did not ask the right questions in the right manner.
